Home Owner
Every apartment owner is legally obliged to be a member of the Home Owners Association. The Home Owners Association must arrange all common matters concerning the complex in question. It does this on the basis of rules such as those stated in the so-called Splitting Act 1998, the Model Regulations 1992, the House Rules, as well as the questions of Who is Responsible for what 2013. The Home Owners Association makes decisions about maintenance, the Home Owners Association contribution, service costs. and the functioning of management.

Membership of the Home Owners Association
Pursuant to the Civil Code, every apartment owner is required to be a member of the Home Owners Association. You can therefore not cancel the Home Owners Association membership. You are no longer a member of the Home Owners Association until you have sold the apartment (and thus the apartment right) and the transfer to the new owner has taken place at the notary.

Purpose and function of the Home Owners Association
The main goal of the Home Owners Association is to promote the common interests of the owners. The Home Owners Association is responsible for the shell and has control over the complex and the land belonging to the building. Management mainly comes down to deciding on the shell, maintenance and use of the communal areas.

The Home Owners Association has several bodies:

The General Members' Meeting
It is mandatory that at least once a year a General Members' Meeting (GMM) of the joint apartment owners is held . This is the highest body of the Home Owners Association. All owners are bound by the decisions taken by the Home Owners Association in the GMM.

The home owners association board/administrator
The law makes it mandatory to appoint a board/manager of the Home Owners Association. The board/manager is the executive body of the Home Owners Association. Other tasks include: drawing up budgets, managing finances, calling meetings and taking out insurance, granting assignments, etc. The board/administrator is appointed by the GMM. The director/manager can be a co-apartment owner, but also an external person or office, such as a real estate agent or an administration / management office. The elected director/administrator implements the decisions taken during the owners' meeting. The board/administrator can also be dismissed by the GMM.

Finance
In order to gain insight into the financial position of the Home Owners Association, an annual balance sheet and profit and loss account are made of all assets and liabilities of the Home Owners Association. Each year, the board/manager must account for the financial management conducted for the Home Owners Association. The board/administrator therefore draws up a budget for the coming year. The budget takes into account the personal contributions that the owners have to pay, as well as the advance amounts for heating costs and the expected expenses. The amount of the personal contribution per owner is determined on the basis of the fractional part that is included in the deed of division of each owner.

The Home Owners Association consists of individual owners of apartments and collective owners who represent the residents to whom they have rented out their apartments. The Home Owners Association has appointed VZB Vastgoed as manager. The board is formed by individual owners. The board is assisted by VZB Vastgoed.
